Berris Law has secured a full acquittal for a client in a high-stakes court martial heard at a Military Court.

The case, which lasted five days, involved serious allegations of sexual assault and was heard before Judge Legard with a fully constituted board.

The Trial Process

The prosecution opened its case by presenting pre-recorded evidence from the complainant, followed by live cross-examination.

Throughout the trial, multiple witnesses gave evidence, including several service personnel and the officer leading the investigation.

Following the close of the prosecution’s case, the defendant gave evidence. This was supported by agreed witness statements and live character testimony presented before the board.

Key Legal Turning Point

A pivotal moment in the proceedings arose when the defence submitted a “no case to answer” application in relation to one of the sexual assault charges.

The Judge upheld this submission, directing the board to return a not guilty verdict on that count without the need for deliberation.

Verdict and Case Outcome

After closing speeches and the Judge’s summing up, the board retired to consider the remaining allegations.

Within two hours, unanimous not guilty verdicts were returned on all outstanding counts.

This outcome represents a complete vindication for the client, who had faced extremely serious allegations with significant personal and professional consequences.
